By now, you have heard the news about Trump’s changes to the “Public Charge” rule. The changes have not even been approved yet, and they will only affect certain people. What does all this mean for you?
First, President Trump wants to make it more difficult for immigrants to become permanent residents in the United States. We are seeing a lot of changes in the systems to get your green card. It is important to stay informed from reliable, serious sources.
Second, the Public Charge rules only affect people applying for permanent residency through their family members. Any changes would not affect anyone applying for a U visa, for asylum, TPS or US citizenship. Also, public benefits received by US citizen children will not be a problem for families.
Third, we will fight. The government has not yet formally introduced the proposed changes. Once they do, we will have 60 days to submit comments about the proposal. We are now preparing to submit more than 100,000 comments nationally. The government must review the comments and hopefully change the rule to reflect the thoughts of the community.
Finally, the rule is not retroactive: once the 60-day public comment period has been completed and the final rule is approved, there will be a 60-day grace period. This means that the earliest that immigrants would need to withdraw from programs to avoid being penalized would be in 120 days, but they should consult with their attorney before making a decision. There is no reason to cancel Medicaid or other vital programs at this time.
