This weekend was the informal “holiday” celebrating marijuana in the US. While the state laws are changing on this issue, the answer remains the same for immigrants – Don’t do it! The president came out with a statement confirming the dangers this week.
The laws affecting immigrants regarding drug use/possession in general are very harsh. Even people who have been permanent residents for decades can be deported for even simple possession of most drugs. The law does not allow the immigration judge to even consider your family or time in the US.
There is a one-time forgiveness for possession of less than 30 grams of marijuana. That generally only applies if you have a spouse or parent that is a US Citizen or permanent resident or you are already a permanent resident. The process to ask for the forgiveness is very difficult and expensive – either a waiver or deportation proceedings.
Over the weekend, the president put out a confirmation that immigrants that work in the marijuana industry will be denied citizenship. He stated that it prevents them from showing good moral character. Remember, that your social media/tattoos may also be reviewed by the US government when they decide your application, whether it is for DACA/TPS or US Citizenship.

¡Las drogas pueden arruinar sus opciones de inmigración!
Este fin de semana fue la “fiesta” informal que celebra la marihuana en los Estados Unidos. Si bien las leyes estatales están cambiando en este tema, la respuesta sigue siendo la misma para los inmigrantes. ¡No lo hagas! El Presidente emitió una declaración confirmando los peligros esta semana.
Las leyes que afectan a los inmigrantes con respecto al uso/posesión de drogas en general son muy severas. Incluso las personas que han sido residentes permanentes durante décadas pueden ser deportadas incluso por simple posesión de la mayoría de las drogas. La ley no le permite al juez de inmigración ni siquiera considerar a su familia o tiempo en los Estados Unidos.
Hay un perdón de una sola vez por posesión de menos de 30 gramos de marihuana. Por lo general, esto sólo se aplica si tiene un cónyuge o padre que es ciudadano estadounidense o residente permanente o usted ya es residente permanente. El proceso para pedir el perdón es muy difícil y costoso, ya sea un perdón o un procedimiento de deportación.
Durante el fin de semana, el Presidente confirmó que a los inmigrantes que trabajan en la industria de la marihuana se les negará la ciudadanía. Afirmó que les impide mostrar buen carácter moral. Recuerde que el gobierno de los EE.UU. también puede revisar sus tatuajes o redes sociales cuando decidan su solicitud, ya sea para DACA/TPS o para la ciudadanía estadounidense.
¡Manténganse seguros, mis amigos! El país está avanzando hacia la legalización de la marihuana, pero aún no hemos llegado.
