The last months have been up and down for DACA. The Supreme Court said early in June that it would not take the case. Then they switched course and ultimately announced last Friday that they would take the case in their next session. The House of Representatives passed the DREAM and Promise Act of 2019 (HR6) in June and now it moves to the Senate.
The Supreme Court will decide if the cancellation of DACA in 2017 was lawful or not. If they decide that it was not lawful, it is possible that the government will accept new DACA applications again. More likely, they will decide that it was lawful, and the government could stop receiving even renewal applications. The Supreme Court is on vacation now until October. They will schedule a date in the Fall/Winter for the attorneys on both sides to argue the case. They will not issue their decision until Spring/Summer (probably June again).
A more permanent solution would be the DREAM and Promise Act. It passed the House of Representatives where friends of immigrants hold the majority. Unfortunately, it will be very difficult to get a vote in the Senate. The KC Metro Immigration Alliance will meet with the staff of all four of our area Senators in the coming weeks. We already met with the staff of Sen. Josh Hawley (R-MO) and Sen. Pat Roberts (D-KS). Realistically, I do not expect this bill to pass until after the 2020 election.
We do not expect any changes to the DACA program for the next year. Even so, the national organizations are recommending that DACA recipients renew now. The USCIS currently is processing the applications in the order they expire, so filing early is not cutting off time on the work cards. We have appointments available throughout July.
