Los inmigrantes indocumentados tienen derechos constitucionales,  según el Centro de Recursos Legales para Inmigrantes.
Al igual que los sospechosos nacidos en Estados Unidos, los inmigrantes indocumentados tienen el derecho de mantenerse en silencio cuando son arrestados. Si por ejemplo son detenidos por el Departamento de Inmigración y Aduanas (ICE por sus siglas en inglés), pueden evitar responder a preguntas hasta que esté presente un abogado.
Algunas veces, los inmigrantes indocumentados son forzados a firmar una orden de salida voluntaria, pero legalmente, no pueden ser forzados a firmar nada. Se les aconseja a los inmigrantes indocumentados no firmar nada sin hablar primero con un abogado.
Además, si un oficial ha detenido a un inmigrante indocumentado sin justificación, se le aconseja al inmigrante indocumentado permanecer tranquilo. Los inmigrantes indocumentados tienen el derecho de preguntarle al oficial si pueden marcharse.
Si un oficial de ICE llega a la casa de un inmigrante indocumentado, el inmigrante puede negarle la entrada hasta que el oficial demuestre un orden de allanamiento. Se les aconseja a los inmigrantes indocumentados no abrir la puerta hasta que vean la orden.
Además, si son arrestados, los inmigrantes indocumentados tienen el derecho de llamar a su consulado. Los mexicanos pueden comunicarse con el Consulado mexicano en Kansas City, Missouri al (816) 556-0800. Los guatemaltecos pueden comunicarse a su consulado llamando al (312) 540-0781. Los salvadoreños pueden comunicarse a su consulado llamando al (312) 332-1393.


Undocumented immigrants have constitutional rights

Undocumented immigrants have constitutional rights, according to the Immigrant Legal Resource Center.
As with American-born suspects, undocumented immigrants have the right to remain silent when they’re arrested. If detained by Immigration and Customs Enforcement (ICE), for example, they can avoid answering questions until a lawyer is present.
Sometimes, undocumented immigrants are forced to sign an order of voluntary departure. But legally, they can’t be forced to sign anything. Undocumented immigrants are advised to not sign anything without talking to a lawyer.
Moreover, if an officer has detained an undocumented immigrant without justification, the undocumented immigrant is advised to remain calm. Undocumented immigrants have the right to ask the detaining/arresting officer if they’re free to go.
If an ICE officer arrives at an undocumented immigrant’s house, the undocumented immigrant can deny entrance unless the officer shows a search warrant. Undocumented immigrants are advised to not open the door unless they see the warrant.
In addition, if arrested, undocumented immigrants have the right to call their consulate. Mexicans may contact the Mexican Consulate in Kansas City, Mo., at (816) 556-0800. Guatemalans may contact their consulate at (312) 540-0781. Salvadorians may contact their consulate at (312) 332-1393.
