Hola amigos- ¡Tengo buenas noticias! Nuevas normas permitirán a cónyuges y padres de Residentes Permanentes aplicar para el perdón dentro de los Estados Unidos. Pues sí, ellos todavía tienen que salir del país, pero sólo por un tiempo breve.
Aquí hay más detalles: El perdón es para inmigrantes a los que no se les permite aplicar para su residencia permanente dentro de los Estados Unidos- normalmente porque entraron sin visa. Ellos tienen que terminar el proceso en su país de origen. Mientras una visita corta a su país sería grandiosa, la ley dice que se tienen que quedar fuera de los Estados Unidos por DIEZ años.
Entonces, el perdón es para evitar pasar diez años fuera de los Estados Unidos. Antes del 2013 todos tenían que pedir perdón fuera de los Estados Unidos. Tenía que ir a la entrevista en el consulado americano, ser negado y después hacer la petición. Esto significaba que las familias eran separadas por meses o años con esperanza que su solicitud sería aprobada.
Mi propia familia pasó por este proceso en el 2007. Pensamos que duraría cuatro meses para que el perdón de mi esposo fuera aprobado en México, pero no recibimos una respuesta por un año. Casi perdimos toda esperanza, pero después mi esposo pudo regresar a los Estados Unidos.
El presidente Obama cambió las normas en el 2013. El permitió a los cónyuges y padres de ciudadanos de los Estados Unidos aplicar para el perdón antes de salir del país. El inmigrante solamente tiene que estar fuera del país por un tiempo breve, normalmente una semana en México o un mes en Centro América. También, hay más seguridad que la entrevista irá bien. El inmigrante viaja a su país de origen ya habiendo arreglado su problema, sin preguntarse si va ser perdonado.
Estábamos muy emocionados cuando el presidente Obama anunció que él iba expandir el programa para Residentes Permanentes en noviembre de 2014. Los cambios pueden ser lentos y hemos esperado casi dos años para hacerse realidad. New Rules Help Families of Permanent Residents!

Hello again friends – I have some great news! New rules will allow spouses and parents of permanent residents to apply for their waiver inside the US. So yes, they still have to leave the country, but only for a very short time.
Here are more details: The waiver is for immigrants that are not allowed to apply for their permanent residency inside the US – usually because they entered without a visa. They have to finish their process in their home country. While a short visit home would be great, the law says they have to stay out of the US for TEN years.
So, the waiver is to avoid spending the ten years outside of the US. Before 2013, everyone had to ask from outside the US. You had to go to the interview at the US Consulate, be denied, then file. This meant families were separated for months and even years while they hoped their application would be approved.
My own family went through this process in 2007. We thought it would take four months for my husband’s waiver to be approved in Mexico, but we didn’t get an answer for a year. We almost lost hope, but then my husband was finally able to return to the US.
President Obama changed the rules in 2013. He allowed spouses and parents of US citizens to apply for the waiver before they left the country. The immigrant only has to be outside the country for a very short amount of time – usually a week for Mexico and a month for Central America. Also, there is more certainty that the interview will go well. The immigrant travels to his home country already having fixed the problem, not wondering if it will be forgiven.
We were very excited when President Obama announced that he would expand the program to Legal Permanent Residents in November 2014. Changes can be slow, and we have waited almost two years for it to be a reality. The USCIS will start taking applications for family members of permanent residents on August 29, 2016.
