California launches investigation of pharmaceutical company

A CNN report on a pharmaceutical company aggressively targeting nursing home residents with a prescription drug has sparked an investigation by the state of California.
California-based drug producer Avanir Pharmaceuticals is being investigated for marketing and selling Nuedexta, which might be unnecessary or unsafe for elderly people. Investigators are trying to determine whether state or federal laws have been broken in selling, marketing or prescribing the drug.
According to the CNN report, doctors have received tens of thousands of dollars to help promote the drug – a violation of laws and ethical codes. Additionally, salespeople were reportedly granted access to patients’ files without consent.
The investigation is focusing on Avanir. However, once investigators have determined if laws have been broken, the nursing homes where the medication was administered also will be examined.
Those nursing homes might include a facility in Los Angeles, where nursing home regulators found that more than a quarter of the residents were prescribed Nuedexta. It also might include a facility where an employee admitted to inspectors that a resident had been given a specific diagnosis to justify using the drug. The employee added that the real reason to prescribe Nuedexta was to control the residents’ “mood disturbances” and yelling.
Although the investigation is in progress and the findings haven’t been made public yet, independent medical experts have confirmed that some of the marketing tactics identified by CNN’s report appear to have crossed ethical lines. The experts also suggested that Avanir salespeople were inappropriately involving themselves in prescription-related decisions.
The issue isn’t new or specific to California. Such activity has allegedly taken place for years and in 19 states.

Un informe de CNN sobre una compañía farmacéutica que se enfoca agresivamente en los residentes de hogares de ancianos con la meta de recetar un medicamento ha provocado una investigación por parte del estado de California.
El productor de drogas Avanir Pharmaceuticals, con sede en California, está siendo investigado por comercializar y vender Nuedexta, una droga que podría ser innecesaria o insegura para las personas mayores. Los investigadores están tratando de determinar si leyes estatales o federales han sido quebradas roto mediante las diferentes tácticas de venta utilizadas por esta empresa.
Según el informe de CNN, los médicos han recibido miles de dólares para ayudar a promover el medicamento, una violación de las leyes y los códigos éticos. Además, según los informes, a los vendedores se les concedió acceso a los archivos de los pacientes sin consentimiento.
Por ahora la investigación se concentra en Avanir. Sin embargo, una vez que los investigadores hayan determinado si se han quebrados leyes, también se examinarán los hogares de ancianos donde se administró el medicamento.
Entre estos podría estar un hogar en Los Ángeles, donde los reguladores de hogares de ancianos encontraron que a más de una cuarta parte de los residentes se les recetó Nuedexta. También podría incluirse un hogar donde un empleado admitió a los inspectores que un residente había recibido un diagnóstico específico para justificar el uso del medicamento. El empleado agregó que la verdadera razón para recetar Nuedexta era controlar los “trastornos del estado de ánimo” de los residentes y sus gritos.
Aunque la investigación está en curso y los hallazgos aún no se han hecho públicos, expertos médicos independientes han confirmado que algunas de las tácticas de marketing identificadas por el informe de CNN parecen haber cruzado las líneas de la ética. Los expertos también sugirieron que los vendedores de Avanir estaban involucrándose de manera inapropiada en decisiones relacionadas con la prescripción.
El problema no es nuevo ni específico a California. Tal actividad ha tenido lugar durante años y en 19 estados.
