U.S. Attorney General William Barr announced Tuesday (April 16) a major reversal from a prior ruling that could lead to immigrants being held indefinitely.
Barr decided that asylum seekers who have established credible fear and are subject to deportation cannot be released on bond by immigration judges. That means the Department of Homeland Security (DHS) will have the sole discretion to decide whether to release immigrants who have crossed the border illegally and later claim asylum.
The ruling could affect thousands of immigrants apprehended at the border, many of whom are seeking asylum.
“Basically, if you pass the initial asylum screening, you can now be indefinitely detained,” immigration attorney Eileen Blessinger told CNN.
The decision marks the first time Barr has used his position to overrule decisions in immigration court. His predecessor, Jeff Sessions, did so, too.
David Leopold, counsel to DHS Watch and former president of the American Immigration Lawyers Association, told CNN Barr’s decision was “senseless” because of the already “overburdened system.”
“It’s an extension of the Jeff Sessions campaign to further strip the immigration courts and immigration judges of their authority,” he said to CNN.
Set to take effect in 90 days, the ruling is seen as part of a range of strategies set to deter what officials call an influx of families crossing the U.S. border and seeking asylum.

El Fiscal General de los Estados Unidos, William Barr, anunció el martes (16 de abril) un cambio importante en una decisión anterior que podría llevar a que los inmigrantes sean retenidos indefinidamente.
Barr decidió que los solicitantes de asilo que han establecido un miedo creíble y están sujetos a deportación no pueden ser liberados bajo fianza por jueces de inmigración. Eso significa que el Departamento de Seguridad Nacional (DHS, por sus siglas en inglés) tendrá la única discreción de decidir si libera a los inmigrantes que han cruzado la frontera ilegalmente y luego solicitan asilo.
El fallo podría afectar miles de inmigrantes detenidos en la frontera, muchos de los cuales están buscando asilo.
“Básicamente, si pasas la evaluación inicial de asilo, ahora puedes ser detenido indefinidamente”, dijo la abogada de inmigración Eileen Blessinger a CNN.
La decisión marca la primera vez que Barr utiliza su posición para anular las decisiones en el tribunal de inmigración. Su predecesor, Jeff Sessions, también lo hizo.
David Leopold, abogado de DHS Watch y ex presidente de la Asociación Americana de Abogados de Inmigración, dijo a la CNN que la decisión de Barr fue “sin sentido” debido al ya “sobrecargado sistema”.
“Es una extensión de la campaña de Jeff Sessions para despojar aún más a los tribunales de inmigración y los jueces de inmigración de su autoridad”, dijo a CNN.
El fallo, que entrará en vigencia dentro de 90 días, se considera parte de una serie de estrategias para disuadir lo que los funcionarios llaman una afluencia de familias que cruzan la frontera de los Estados Unidos y buscan asilo.
