The Trump administration released a regulation Monday (Aug. 12) that could make it easier to reject green card and visa applications, thus reducing the number of legal immigrants allowed to enter and stay in the United States.
Under the rule, many green card and visa applicants could be rejected if they have low incomes or little education, or have used benefits, such as most forms of Medicaid, food stamps and housing vouchers.
“We certainly expect people of any income to be able to stand on their own two feet, so if people are not able to be self-sufficient, then this negative factor is going to bear very heavily against them in a decision about whether they’ll be able to become a legal permanent resident,” explained Ken Cuccinelli, acting U.S. Citizenship and Immigration Services director, during a briefing in the White House.
The rule does not apply to asylum seekers or refugees.
Officials such as New York Attorney General Letitia James have announced plans to sue to block the rule.
“President Trump’s new public charge rule is yet one more example of his administration turning its back on people fighting to make a better life for them (sic) and their families,” said James in a statement, published by CNN and other media outlets.
The rule will take effect Oct. 15.

La administración de Trump emitió un reglamento el lunes (12 de agosto) que podría facilitar el rechazo de solicitudes de tarjeta verde y visa, así reduciendo el número de inmigrantes legales que pueden ingresar y permanecer en Estados Unidos.
Bajo esta regla, muchos solicitantes de tarjeta verde y visa podrían ser rechazados si tienen bajos ingresos o poca educación, o si han usado beneficios, como la mayoría de las formas de Medicaid, cupones de alimentos y vales de vivienda.
“Ciertamente esperamos que las personas de cualquier ingreso puedan sostenerse por sí mismas, por lo que si las personas no pueden ser autosuficientes, entonces este factor negativo tendrá una gran influencia contra ellos en una decisión sobre si poder convertirse en un residente legal permanente”, explicó Ken Cuccinelli, director interino de los Servicios de Ciudadanía e Inmigración de Estados Unidos, durante una sesión informativa en la Casa Blanca.
La regla no se aplica a los solicitantes de asilo o refugiados.
Funcionarios como la Fiscal General de Nueva York Letitia James han anunciado planes para demandar para bloquear la regla.
“La nueva regla de cargo público del presidente Trump es un ejemplo más de que su administración le da la espalda a las personas que luchan por mejorar su vida y la de sus familias”, dijo James en un comunicado, publicado por CNN y otros medios de comunicación.
La regla entrará en vigencia el 15 de octubre.
