Kelly signs executive order cancelling evictions in Kansas

Kansas Gov. Laura Kelly signed an executive order that rescinds (cancels) a previous order. With this in mind, we have reviewed a portion of the information provided above.
On the March 17, Governor Kelly issued an executive order concerning rental evictions and mortgage foreclosures in our state. In order to provide additional details, and alleviate uncertainty, the order was rescinded (cancelled). A new and enhanced order was issued on March 23, 2020, Executive Order 20-10, link – https://governor.kansas.gov/wp- content/uploads/2020/03/EO-20-10-Executed.pdf. Be advised, while not summarized in this document, the Governor’s order also applies to mortgage foreclosure – Call HCCI for details.
The order outlines the following:

• Landlords shall not evict a tenant when the rent default is due to a financial hardship caused by the consequences of the COVID-19 pandemic. Specifically, a financial hardship includes:
1. An individual or family suffers a significant loss of income, significant increase in necessary expenses or inability to work as a direct or indirect result of the COVID-19 pandemic
2. The individual’s or family’s financial resources are depleted to the extent that making rent payments would leave them unable to purchase food, medicine or other supplies, or services necessary to their health and safety.
* Both 1 and 2 must apply.
• This order became effective on March 23, 2020 and will remain in force until rescinded, until May 1, 2020, or until the statewide State of Disaster Emergency proclaimed on March 12, 2020, relating to COVID-19 expires, whichever is earlier.
* With the above being stated, tenants affected by the financial repercussions of COVID-19 will still owe past due and current rent. Eviction proceedings can go forth after the order has expired.
• Landlords are encouraged (not ordered) to negotiate payment plans or other agreements to allow renters to address any late or non-payments, or late fees.
• The order does NOT prohibit the continuation of any judicial eviction proceedings filed before the effective date of this order. Though it should be noted – the Kansas Supreme Court released Administrative Order 2020-PR- 016, link, 
Administrative Order 2020-PR-016 on March 18, 2020 directing all district and appellate courts to cease all but emergency operations until further order. Even though evictions are on hold, such evictions have been or will be rescheduled and go forth once courts reopen.
• The order does NOT relieve tenants who have NOT suffered a financial hardship resulting from the COVID-19 pandemic from their obligation to comply with the rental agreements or to continue making rent payments. 

• The order does NOT prevent evictions for rental agreement defaults (example, nonpayment of rent) or violations (example, 14/30-day notice of tenant noncompliance with the rental agreement) not due to a financial hardship resulting from the COVID-19 pandemic.

La renta tardia y el desalojo en Kansas

La gobernadora Laura Kelly firmó una orden ejecutiva que rescinde (cancela) una orden anterior. Con esto en mente, hemos revisado una porción de la información provista anteriormente.
El 17 de marzo, la gobernadora Kelly expidió una orden ejecutiva sobre los desalojos de alquileres y embargos de hipoteca en nuestro estado. Para proveer detalles adicionales, y mitigar incertidumbre, la orden fue rescindida. Una orden nueva y mejorada fue expedida marzo 23, 2020, Orden Ejecutiva 20-10, enlace – https://governor.kansas.gov/wp- content/uploads/2020/03/EO-20-10-Executed.pdf. Este al tanto, aunque no se resume en este documento, la orden de la gobernadora también aplica a embargos de hipoteca – Llame a HCCI para más detalles.
La orden traza lo siguiente:
• Los propietarios no desalojaran al inquilino cuando la falta de renta se debe a dificultad financiera causada por las consecuencias de la pandemia de COVID-19. Específicamente, una dificultad financiera incluye:
1. Un individuo o familia sufre de pérdida de ingresos significante, aumento significante de en gastos necesarios o inhabilidad para trabajar como resultado directo o indirecto de la pandemia de COVID-19
2. Los recursos financieros del individuo o de la familia se han agotado al grado que hacer pagos de renta los dejaría sin poder comprar alimento, medicamento u otros suministros o servicios necesarios para su salud y seguridad.
* Ambos 1 y 2 deben aplicar.
• Esta orden se hizo efectiva marzo 23, 2020 y permanecerá vigente hasta rescindida, hasta May 1, 2020, o hasta que la Emergencia de Estado de Desastre estatal proclamada marzo 12, 2020 en relación con el COVID-19, expire, lo que suceda primero.
* Con lo estipulado anteriormente, los inquilinos impactados por las repercusiones financieras del COVID-19 aún deberán renta pasada y actual. Las acciones de desalojo podrán proceder después de que la orden expire.
• Se alienta (no se ordena) a los propietarios a negociar arreglos de pago u 
otros acuerdos para permitir a los inquilinos cubrir renta atrasada o faltante, o 
recargos de pagos tardíos.
• La orden NO prohíbe la continuación de cualquier proceso judicial de 
desalojo hecho antes de la fecha efectiva de esta orden. Aunque debe notarse – la Corte Suprema de Kansas emitió la Orden Administrativa 2020- PR-016, enlace, Administrative Order 2020-PR-016 en marzo 18, 2020 dirigiendo a todos los tribunales del distrito y de apelación a cesar todas las operaciones, excepto emergencias, hasta nuevo aviso. Aunque los desalojos están en espera, dichos desalojos han sido o serán reprogramados y procederán una vez que las cortes reabran.
• La orden NO exime a inquilinos que NO han sufrido de dificultad financiera como resultado de la pandemia de COVID-19 de sus obligaciones de cumplir con el acuerdo de arrendamiento o de continuar haciendo pagos de renta.
• La orden NO previene desalojos por faltas al contrato de arrendamiento (ejemplo, no pagar renta) o violaciones (ejemplo, avisos de incumplimiento del inquilino con el contrato de arrendamiento de 14/30 días) que no se deban a la dificultad financiera resultado de la pandemia de COVID-19.
