Friends, we have been up and down with DACA over the last year. Right now, two court cases are pending about DACA – one would make it better, one would make it worse. We have to plan for the worst and hope for the best. Take action now to prepare yourself to ride out the storm!
We are worried about the lawsuit in Texas. It is with Judge Hanen, the same judge that denied DAPA (work permits for parents). The hearing is on August 8th and is brought by anti-immigrant states saying that DACA was illegal all along. We expect the Judge to give his decision about a week later. It is possible that he will stop USCIS from accepting DACA renewal applications. Therefore, we are urging anyone with a DACA work card expiring in 2019 to renew now!
The other major case that is pending would improve things. Judge Bates in Washington DC said that the cancellation of the DACA program was done in an illegal way. He was the third judge since January to say this. His decision said the whole program should restart, including first-time applications and travel permits. He gave the government 90 days to give a better explanation of why the DACA program should be cancelled. The time is now up, but we are waiting for the judge to take further action. It is a good idea to prepare yourself with the money and evidence now.
