La reciente decisión 4-4 de la Corte Suprema en la Acción Diferida para los padres de los estadounidenses y residentes legales permanentes (DAPA) y la extendida Acción Diferida para los Llegados en la Infancia (DACA) decepcionó a los partidarios de la comunidad inmigrante y la reforma migratoria.
Pero ahora más que antes, esta decisión podría motivar a los latinos elegibles para votar en las elecciones de este año. Las elecciones presidenciales y legislativas de este año todavía puede hacer una diferencia, dijo la abogada de inmigración Susan Song.
“Es importante para todos los votantes elegibles que voten en estas elecciones”, dijo Song. “Animamos a todos los electores elegibles y registrados que voten para elegir al presidente que apoya la reforma migratoria, así como los candidatos en la Cámara y el Senado.”
Song agregó que el caso es probable que vuelva al tribunal de origen, lo que significa que podrían pasar años antes de que el caso llegue a la Corte Suprema de nuevo.
La muerte de Antonin Scalia en febrero dejó un asiento vacante y no se llenó a tiempo antes de la decisión. Song dijo que votar por los candidatos presidenciales y legislaciones adecuadas podría tener una influencia sobre el nominado para ocupar el asiento del Scalia y dar lugar a una decisión favorable.
“Actualmente, el Senado no quiere llevar a cabo una audiencia para el candidato del presidente Obama para el juez”, dijo Song. “Si el candidato de Obama no se considera en el Congreso durante los meses restantes de su mandato, el próximo presidente designará a su propio juez.”
Song también hizo hincapié en que esta decisión no afecta al programa de DACA existente, y los solicitantes elegibles pueden solicitar el programa o renovar su estado.
Song, sin embargo, advierte a otros sobre posibles fraudes notarios en el caso de DAPA.
“Nadie puede solicitar DAPA en este momento”, dijo. “No le dé su dinero a cualquier persona que prometa que van a ayudarle a solicitar DAPA porque nadie puede hacer eso en este momento.”

Supreme Court’s decision is an important reminder to vote

The recent Supreme Court 4-4 deadlock on the Deferred Action for Parents of Americans and Lawful Permanent Residents (DAPA) and the extended Deferred Action for Childhood Arrivals (DACA) programs disappointed the immigrant community and immigration reform supporters.
But now more than before, this decision might compel eligible Latinos to vote in this year’s election. Voting in this year’s presidential and congressional elections can still make a difference, immigration attorney Susan Song said.
“It’s important for every eligible voter to vote in these elections,” Song said. “We encourage everyone who is eligible and registered to vote to choose the president who supports immigration reform, as well as the candidates in the House and the Senate.”
Song added that the case will likely go back to the original court, meaning that it could be years before the case reaches the Supreme Court again.
The death of Justice Antonin Scalia in February left a vacant seat and was not filled in time before the decision. Song said that voting for the right presidential and congressional candidates could have an influence on the person who’s nominated to fill Scalia’s seat and result in a favorable decision.
“Currently, the Senate doesn’t want to hold a hearing for President Obama’s nominee for Supreme Court judge,” Song said. “If Obama’s nominee is not considered in Congress during the remaining months of his presidency, the next president will nominate their own judge.”
Song also emphasized that this decision doesn’t affect the existing DACA program, and eligible applicants can apply for the program or renew their status.
Song, however, warns others of potential notary fraud in the case of DAPA.
“No one can apply for DAPA at this moment,” she said. “Don’t give your money to anyone promising that they will help you apply for DAPA because nobody can do that right now.”
The Department of Homeland Security will continue to implement the revised enforcement priorities announced on November 20, 2014. DHS is focusing its deportation resources specifically on the removal of convicted criminals, threats to public safety and national security, and people who entered illegally after January 1, 2014.
