An Ashland, Missouri, family filed a lawsuit on June 16 against the Southern Boone County R-I School District — located near Columbia, Missouri — and its board of education and other parties, claiming the district failed to handle bullying incidents, according to a press release by the family’s attorney.
Tawnya and Michael Samuel and their attorney, Tarak Alexander Devkota, filed the lawsuit in federal court on behalf of the Samuels’ son. The Samuels claim their son has suffered severe physical and emotional trauma at school.
“The defendants have displayed a historical pattern of willful disregard to the effects of student bullying,” the press release stated. “Presently, the Samuel family, along with other parents, have raised their concerns that a willful disregard for student safety may result in student injury or death.”
According to the lawsuit, the boy has been the object of “name-calling, tripping, kicking, pushing, threats of physical harm.” The boy was also hit and choked by students and accused of lying by teachers and staff.
“We’ve gone to the school board” said Michael Samuel in a YouTube video, posted by Devkota Law Firm LLC. “We’ve laid out having guest speakers. We’ve talked to the principal, and we’ve had private meetings. We’ve had lots of issues with bullying, all the way to the point of student bullying and teachers bullying, and possibly some administration.”
Devkota told ABC 17 News that the lawsuit was the last resort for the Samuels in getting their complaints heard and addressed.
“The Samuel family has exhausted every remedy they had administratively and their complaints fell on deaf ears,” Devkota said. “The only way to awaken a deaf ear is to smack somebody with a petition for damages, where there might be economic damage caused to them; and then, they might change police (sic) to stop these suits from happening. So it’s important, it’s imperative, that this lawsuit be filed because they have been left with no other option.”

“Los acusados han mostrado un patrón histórico de desprecio intencional a los efectos del acoso escolar”, declaró el comunicado de prensa. “Actualmente, la familia Samuel, junto con otros padres, ha expresado sus preocupaciones de que un desprecio intencional por la seguridad de los estudiantes puede provocar lesiones o muerte de los estudiantes”.
Según la demanda, el niño de 10 años ha sido sometido a ser insultado, hacerlo tropezarse, ser pateado, ser amenazado con daño físico, ser golpeado y ahogado por estudiantes y acusado de mentir por maestros y personal.
“Hemos ido a la junta escolar. Hemos ofrecido tener oradores invitados. Hemos hablado con el director, y hemos tenido reuniones privadas”, dijo Michael Samuel, en un video de YouTube publicado por Devkota Law Firm LLC. “Hemos tenido muchos problemas con el acoso escolar hasta el punto de la intimidación de los estudiantes y el acoso escolar, y posiblemente alguna administración”.
Devkota le dijo a ABC 17 News que la demanda fue el último recurso para los Samuels para que se escuchen y aborden sus quejas.
“La familia Samuel ha agotado todos los remedios que tenían administrativamente y sus quejas cayeron en oídos sordos”, dijo Devkota. “La única forma de despertar un oído sordo es golpear a alguien con una petición de daños, donde podría haber daños económicos causados; Y luego, podrían cambiar a la policía (sic) para evitar que ocurran estos trajes. Por lo tanto, es importante, es imperativo, que esta demanda se presente porque se han quedado sin otra opción”.
