Good news this week from the Courts and Congress! The DREAM and Promise Act would provide a path to permanent residency and ultimately citizenship for Dreamers and TPS recipients. It is only a proposal at this time and we are still relying on the Courts to keep DACA and TPS alive.
The bill has been introduced in the House of Representatives where there are a majority of Democrats. It is likely to pass eventually and move to the Senate. That is where the problems will start. Although most Americans want a solution for Dreamers/TPS recipients, the leader of the Senate, Mitch McConnell has blocked many bills that President Trump does not like. Even if it passed the Senate, President Trump would have to sign it. This will be very difficult.
It is a good start for the debate! We need to keep talking about positive solutions for our community. Talk to your friends and family members about registering to vote and becoming US citizens if they are eligible. Also, it is a good idea to explore other options available to you through family as the law is not likely to change until 2021.
For now, the DACA program renewals and the TPS program are protected by orders from the Federal Court. This week, Honduras and Nepal were added to the lawsuit that is extending the time their TPS is valid. Now, work permits for most TPS holders will be automatically extended for nine months at a time while the lawsuit is pending. Stay tuned for more information. All TPS holders should explore future options like obtaining permanent residency through family. In many cases, it is a good idea to obtain a travel permit and take a trip outside the US to ensure you have a legal entry for the future.
