The Special Immigrant Juvenile Status is a program for young immigrants living in this country without their parents. Attorney Jessica Piedra explains more about this program.
Q. There are many young immigrants here in the United States without their parents, what options do they have to adjust their status?
A. The government recognizes that their lives are difficult. They can apply for a program called “Special Immigrant Juvenile Status” and it can result in their residency!
Q. What are the steps to apply?
A. First, schedule a consultation with an immigration attorney. When we determine whether they qualify or not, we connect them with a family law attorney to obtain a court order stating that at least one parent has abandoned them. When we have this, we can proceed to apply with immigration.
Q. Can only young people without both parents apply or can single parents help their children?
A. Single parents can help their children now too! With this we can obtain the custody order. If it is an aunt or some other relative, it is a guardian order.
Q. Is there a risk to the adult involved?
A. Not at all, there is no risk for them. Your immigration status does not matter for family court, nor does immigration care.
Q. Is it only for those who are in deportation court?
A. No, any young person can apply. This is a good option for young people who can’t get DACA right now or really any undocumented young person who is in the United States without both parents.

Un programa que muchas personas no conocen es el Estatus Especial para Jóvenes inmigrantes que viven en este país sin sus padres. La abogada Jessica Piedra nos explica más sobre este programa.
P. Hay muchos jóvenes inmigrantes aquí sin sus padres, ¿qué opciones tienen para arreglar su estatus?
R. El gobierno reconoce que su vida es difícil. ¡Pueden aplicar para un programa que se llama “Estatus Especial para Jóvenes” y puede resultar en su residencia!
P. ¿Cuáles son los pasos para aplicar?
A. Primero, una consulta con una abogada de inmigracion. Cuando determinemos que califican, les conectamos con una abogada de leyes familiares para obtener una orden en la corte que indique que a lo menos uno de sus padres les ha abandonado. Cuando tenemos esto, podemos proceder a aplicar con la inmigración.
P. ¿Sólo los jóvenes sin sus dos padres pueden aplicar o padres solteros pueden ayudar a sus hijos?
R. ¡Padres/Madres solteras pueden ayudar a sus hijos también ahora! Con esto podemos obtener el orden de custodia. Si es una tía o algún otro familiar es orden de tutor.
P. ¿Hay riesgo para el adulto que está involucrado?
R. No, no hay riesgo para ellos. No importa su estatus migratorio para la corte familiar, ni le interesa a inmigracion.
P. ¿Es sólo para quienes están en corte de deportación?
R. No, cualquier joven puede aplicar. Esto es buena opción para los jovenes quienes no pueden obtener DACA ahora o realmente cualquier joven indocumentado que está en los Estados Unidos sin los dos padres.
