¡Hola amigos! Acabo de regresar de una conferencia sobre los detalles de la nueva exención! Los expertos de la Asociación Americana de Abogados en Inmigración (AILA, por sus siglas en inglés) compartieron la información más reciente sobre la manera en que las nuevas reglas de la exención pueden ayudar y dañar a tu familia.
Primero las nuevas noticias, las nuevas reglas le permiten que ciertos residentes permanentes cuenten para obtener una exención. Recuerde, esto es casi siempre el cónyuge que puede ayudar. Algunas veces un padre de edad mayor puede ayudar a su hijo o hija adulta, pero la exención no permite a los hijos ayudar a sus padres. El problema es que existe un período de espera para los cónyuges de residentes permanentes y un período de espera muy largo para hijos de padres residentes permanentes para poder terminar el proceso de inmigración. Aquí es donde podemos ser creativos e implicar a los hijos ciudadanos americanos adultos a que tomen el primer paso, luego que el cónyuge o padre residente permanente ayude con la exención, y terminar el proceso con el hijo ciudadano de Estados Unidos en el consulado en el país de origen del inmigrante. En su cita, exploraremos todas las opciones y establecer un plan para tu familia.
Segundo las malas noticias, el servicio de inmigración ya no negará exenciones si tienes otros problemas en tus antecedentes. Bajo las reglas antiguas, el servicio de inmigración podría negar tu exención provisional si ellos pensaban que tenías otros problemas que evitarían que tú tuvieras una visa en el consulado de Estados Unidos. Ahora, ellos no buscarán esos problemas. Será muy importante que un abogado con experiencia revise todos los detalles de tus antecedentes de inmigración y criminales para encontrar cualquier problema que pueda dar como resultado que tú te quedes trabado en tu país de origen por los 10 años o posiblemente para siempre.

How can the new Waiver rules help and hurt?

Hello friends!  I’m just back from a conference on the details of the new waiver!  Experts from the American Immigration Lawyers Association (AILA) shared the latest information about how the new waiver rules can help and hurt your family.
First, the good news, the new rules allow certain permanent residents to count for getting a waiver.  Remember, this is almost always the spouse that can help.  Sometimes an elderly parent can help their adult son/daughter, but the waiver does not allow children to help their parents.  The problem is that there is a waiting period for spouses of permanent residents and a very long waiting period for sons/daughters of permanent resident parents to be able to finish the immigration process.  This is where we can get creative and involve the adult US citizen children to do the first step, then have the permanent resident spouse/parent help with the waiver, and finish the process with the US citizen son/daughter at the Consulate in the immigrant’s home country.  At your appointment, we will explore all options and map out a plan for your family.
Second, the bad news, the immigration service will no longer deny waivers if you have other problems in your history.  Under the old rules, the immigration would deny your provisional waiver if they thought you had other problems that would prevent you from getting your visa at the US Consulate.  Now, they will not look for those problems.  It will be very important to have an experienced lawyer review all the details of your immigration and criminal history to find any problems that could result in you being stuck in your home country for the full ten years or possibly forever.
