Voces Consulares: In defense of H2A visa workers

The organization Ayuda Legal of North Carolina (ALNC) requested collaboration from the Mexican government to locate people who have worked with H2A visas in the United States, to include them as plaintiffs in a case of violation of labor rights.
The possible interested parties are people who have worked for Francisco Valadez Jr. or “Los Panchos”, with an H2A visa, in 2018 or later.
Claims must be filed no later than March 7, 2022, and will be included in the Moshan-Martinez, et. al. v. Francisco Valadez, Jr. LLC et. al., regarding a class action lawsuit filed by farmworkers.
Those who have filed the lawsuit claim that they were not paid the minimum wage and were not reimbursed for various expenses, such as the cost of the visa, the recruitment fee, transportation and accommodation in Mexico associated with the visa process, and meals upon arrival in the United States, among others.
Every year, thousands of Mexican people move to the United States with H2A visas to perform temporary agricultural jobs in various states of this country.
H2A visa holders are entitled to receive a written contract in Spanish, with information regarding salary, hours, working conditions, and employment benefits.
Also, to receive at least twice a month their salary payment, including all hours worked. The salary cannot be less than the minimum wage or the one agreed in the contract, regardless of the number of pieces that are collected or completed.
Other protections include a work environment free from discrimination and violence.
According to preventive information from the Consular Protection area of the Mexican Ministry of Foreign Affairs, the employer must cover the costs of the visa, transportation and sustenance from the place of origin in Mexico to the place of employment in the United States.
If the H2A worker has to cover those expenses or a part of them, the employer must reimburse him or her, no later than when 50 percent of the contract is fulfilled.

En defensa de trabajadores con visa H2A

La organización Ayuda Legal de Carolina del Norte (ALNC) solicitó colaboración del gobierno de México para localizar personas que hayan trabajado con visas H2A en Estados Unidos, para incluirles como demandantes en un caso por violación de derechos laborales.
Los posibles interesados son personas que hayan trabajado para Francisco Valadez Jr. o “Los Panchos”, con visa H2A, en 2018 o en fecha posterior.
Los reclamos deberán presentarse a más tardar el 7 de marzo de 2022 y se integrarán al caso Moshan-Martinez, et. al. v. Francisco Valadez, Jr. LLC et. al., relativo a la demanda colectiva interpuesta por trabajadores agrícolas.
Quienes han presentado la demanda señalan que no se les pagó el salario mínimo y no se les reembolsaron diversos gastos, como el costo de la visa, la tarifa de reclutamiento, el transporte y alojamiento en México asociados al trámite de la visa, y alimentos al arribo a Estados Unidos, entre otros.
Cada año, miles de personas mexicanas se trasladan a Estados Unidos con visas H2A para realizar trabajos agrícolas temporales en varios estados de este país.
Quienes tienen una visa H2A tienen derecho a recibir un contrato por escrito y en español, con información sobre el salario, horarios, condiciones de trabajo y beneficios del empleo.
Asimismo, recibir por lo menos dos veces al mes el pago de salario, incluyendo todas las horas trabajadas. El salario no puede ser menor al salario mínimo o al acordado en el contrato, independientemente del número de piezas que se recolecten o completen.
Otras garantías incluyen un ambiente de trabajo libre de discriminación y violencia.
De acuerdo con información preventiva del área de Protección Consular de la Cancillería mexicana, el empleador debe cubrir los costos de la visa, transporte y subsistencia desde el lugar de origen en México hasta el sitio de empleo en Estados Unidos.
Si la persona trabajadora H2A tiene que cubrir esos gastos o una parte de ellos, el empleador debe reembolsarlos, a más tardar, cuando se cumpla el 50 por ciento del contrato.
